With a private judge, you're asking someone to actually decide the case, similar to a regular judge, when you want a resolution rather than a negotiated settlement.

Do both sides have to agree to use a private judge? Yes. It's a voluntary alternative to the standard court process, so both parties have to consent before a private judge can be used.

Can a private judge's decision be appealed? Yes, the same as you could appeal a decision from a regular judge. That's part of why Indiana requires private judges to have real judicial experience: the role carries the same authority and appeal rights as a regular court decision.

Why does a private judge need judicial experience? Under Indiana's ADR rules, a private judge must have served as a judge for at least four consecutive years. I served as magistrate of the Jennings County Courts from July 2021 to December 31, 2025, when the position was eliminated by House Bill 1144, which satisfies that requirement, and I'm listed as a Registered Private Judge on the Indiana Office of Judicial Administration's official roster.
